These terms apply to buildkitly.com and to everything you buy from us. By placing an order or creating an account you agree to them. If you do not agree, do not use the site.
1. Who we are
BuildKitly (“we”, “us”) runs buildkitly.com. Contact: support@buildkitly.com (support and orders), sale@buildkitly.com (quotes and projects).
2. What we sell
Themes: ready-made website themes for WordPress, Shopify and Next.js. Every theme costs $9 per platform.
Installation (from $29 per site) and customization (from $99) are services, not products sold through checkout. We quote them individually and arrange them separately by email. Scope, price and timeline are agreed in writing before work starts, and payment for these services is arranged by us as set out in the written quote.
Installation: we install a theme on your site.
Customization: design and feature changes to a theme or site.
Prices are in US dollars. Taxes, if any, are calculated and collected at payment.
3. Orders and payment
Theme payments at checkout are handled by Lemon Squeezy, our reseller and merchant of record. Installation and customization are not paid through checkout or Lemon Squeezy. By paying at checkout you also agree to Lemon Squeezy’s terms for the transaction. We do not see or store your card details. An order is accepted when payment is confirmed. We may refuse or cancel an order for suspected fraud or a pricing error, and we refund you in that case.
4. Delivery
Themes are digital. We deliver by email and in your account. Themes marked “Instant download” are available as soon as your payment is confirmed. Themes marked “Made to order” are prepared after payment and we email the download link when it is ready, with no specific delivery time promised. See the Delivery Policy.
5. License to use a theme
When you buy a theme you receive a non-exclusive, non-transferable license to use it on any number of websites that you own or build for your clients, for personal or commercial projects. You may modify the theme for those sites.
You may not: resell, share, sublicense or redistribute the theme files (alone or in a bundle, template pack or competing marketplace); present the theme as your own work in a marketplace; or remove copyright notices from the code. The license covers the theme package. Third-party fonts, images, plugins and libraries inside it keep their own licenses.
Demos show the intended design. Demo images and sample content may not be included in your download.
6. Updates and support
We send theme updates by email for as long as we publish updates for that theme. Support covers installing the theme as documented and fixing defects in the theme itself. It does not cover custom development, third-party plugins, hosting problems or content creation, which are available as separately quoted services. Support is by email at support@buildkitly.com.
7. Installation and customization services
Installation and customization are quoted individually and arranged separately by email. They are not sold through checkout or through Lemon Squeezy, and the scope, price, timeline and payment arrangements are agreed in writing before work starts. We start work when that written agreement is in place and you have given us the access and information we need. You are responsible for having a current backup of your site and for the rights to any content you give us. Never send passwords by email; we will arrange secure access. A written quote or order confirmation describes what is included; anything else is out of scope and quoted separately.
8. Accounts
You can buy as a guest or create an account. You are responsible for your password and for activity under your account. Give accurate information. We may suspend an account used for fraud, abuse or breach of these terms.
9. Reviews and content you submit
Only customers who bought a theme can review it. You keep ownership of your review but give us a free, worldwide license to display it on our site and in related marketing, with your chosen display name. Reviews must be honest, lawful and not contain personal data, advertising or abuse. We may remove reviews that break these rules.
10. Acceptable use
Do not misuse the site: no scraping or copying of the catalogue, attacks, attempts to bypass limits or security, uploading malware, or using the site for unlawful purposes. We rate-limit and block abusive traffic.
11. Intellectual property
The BuildKitly name, logo, theme designs, code, copy and graphics belong to us or our licensors. These terms give you only the rights stated here.
12. Disclaimer
Themes and services are provided “as is”. We do not guarantee that a theme will meet your particular needs, work with every plugin, host or browser, or be error-free. Compatibility notes on theme pages are guidance based on our testing.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect or consequential loss (lost profit, lost data, lost business). Our total liability for any claim relating to a purchase is limited to the amount you paid for it. Nothing in these terms limits liability that cannot be limited by law, or your statutory consumer rights.

15. Privacy and cookies

16. Changes
We may update these terms. The version published on the site when you order applies to that order. Material changes are announced on this page with a new “Last updated” date.
17. Governing law
These terms are governed by the laws of the jurisdiction where BuildKitly is established, without limiting the mandatory consumer rights you have in your country of residence.
